This User Agreement describes the terms on which crowdSPRING, LLC (“crowdspring”, “we”, “us”), an Illinois limited liability company with its principal place of business in Chicago, Illinois, offers you (“you” or “your”) access to our site (including all content and functionality available through crowdspring.com), and services provided by us. By visiting or using the services available on crowdspring.com (the “Site” or “crowdspring.com”) you are agreeing to the following terms without change, including those terms available by hyperlink (collectively, the “Agreement”). If you do not agree to any of the terms in this Agreement and the related policies referenced in this Agreement, please do not use this Site.

Only parties that can lawfully enter into and form legal contracts may use the Site and our services. If you use our services, you expressly represent to us that you are at least over the age of eighteen (18) and may lawfully enter into and form binding contracts, conditions, obligations, affirmations, representations and warranties. We reserve the right in our sole and absolute discretion to refuse, suspend, or terminate service to anyone.

We may collect Personal Information from you, such as your name, e-mail and mailing addresses, phone number, and password when you create an account with us (“Account”).If you are a Designer, we may require that you provide your tax information (e.g., social security number).When you make a purchase, we (or our third party service provider) will collect all information necessary to complete the transaction, including your name, credit card information, debit card information, billing information and/or PayPal information.We retain information on your behalf, such as Design Briefs, Design Contests, Design Concepts, Design Templates, Invoice Service invoices, transactional history, messages and any other information that you store using your Account.

5. Fees

99designs and our marketing partners, affiliates, or analytics or service providers use cookies or similar technologies in analyzing trends, administering the website, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

6. Warranty Disclaimer

We currently use Google Analytics as well as Google Analytics for Display Advertising. Google Analytics collects information anonymously and reports website trends without identifying individual visitors. Google Analytics uses its own cookie to track visitor interactions. Website owners can view a variety of reports about how visitors interact with their website so they can improve their website and how people find it.
